ASIC has released Regulatory Guide 234 Advertising financial products and advice services: Good practice guidance.
The purpose of the Guide is to help organisations promoting products or advice services avoid engaging in misleading or deceptive conduct.

As always, remember that the content of ASIC Regulatory Guides is not itself law. However, as it sets out ASIC’s interpretation of the law, it should be highly instructive in how to promote your products and services.
- Product issuers;
- Licensees providing financial advice;
- Other parties promoting products on behalf of someone else – such as distributors; and
- Lawyers, compliance staff and marketing teams responsible for creating or signing off marketing materials promoting products or services.
Also, at a recent meeting of the Independent Compliance Committee Members Forum, ASIC indicated that it would be taking action where it could, in relation to advertising.
Tip: Have your marketing team read the Guide. Consider how you will change your internal processes regarding advertising. Consider the respective roles that your marketing, legal and compliance teams will play in implementing the new ASIC guidance.
