Electronic Signatures (Archived 2021-08-25)

This policy helps licensees and their representatives understand when an electronic signature can be used instead of a traditional “wet” signature.  It considers the Electronic Transactions Act 1999 (Cth), and section 127 of the Corporations Act 2001 (Cth).  It also addresses some Federal and State legislation that is effective during COVID-19 under a heading titled “Signing and witnessing documents under emergency laws”.

The policy helps licensees establish a protocol for when an electronic signature is permitted.  It also helps licensees decide when to require digital signatures – that is – signatures made using technology that provides greater assurance of identity and message integrity.
